These Terms of Use (“Terms”) govern your access to and use of the Pulsey mobile application (the “App”), published by Codivo (“Codivo”, “we”, “us”, or “our”). By installing or using the App, you agree to these Terms and to our Privacy Policy at https://www.codivo.io/pulsey/privacy. If you do not agree, do not use the App.
You must be at least 18 years old (or the age of majority in your jurisdiction) to use the App. If you use the App on behalf of another person, you represent that you have the legal authority to do so and to accept these Terms on their behalf.
The App is intended to help you attempt to listen to body sounds and keep personal records. It is not a substitute for professional medical care, fetal monitoring, or prenatal examinations. Do not rely on the App for medical decisions. If you have any concerns about pregnancy or fetal health, contact a qualified healthcare professional immediately and follow their advice.
Use the App only in safe conditions. Do not use it while driving or during activities that require your full attention. Follow all in-app guidance and your healthcare provider’s instructions.
Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to install and use the App on devices you own or control, solely for personal, non-commercial use. We reserve all rights not expressly granted.

The audio you record and any notes or session data you create (“User Content”) remain yours. User Content is stored locally on your device unless you choose to export or share it. You are responsible for backing up, managing, and deleting your User Content. If you share User Content via iOS share sheet or other services, those services’ terms and privacy policies apply. You represent that you have the necessary permissions to create and share any User Content.
You grant Codivo a worldwide, non-exclusive, royalty-free license to use feedback you voluntarily provide (e.g., bug reports, feature ideas) to improve our products and services without restriction or obligation.

The App may allow you to share content using third-party services (e.g., messaging, email, cloud storage). We are not responsible for third-party services and do not control their terms or privacy practices.
We may provide updates, upgrades, or changes to the App, including automatic installations. The App and its features may change or be discontinued at any time. Continued use after updates constitutes acceptance of the updated App and Terms.
You may stop using the App at any time and delete it from your device. We may suspend or terminate your access if you violate these Terms or if we discontinue the App. Upon termination, the license in Section 4 ends and you must stop using the App. Sections that by their nature should survive termination will survive (including ownership, disclaimers, limitations of liability, and dispute provisions).
THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, CODIVO DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, QUIET ENJOYMENT, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL DETECT ANY SOUND, PRODUCE ACCURATE MEASUREMENTS, OR BE ERROR-FREE OR UNINTERRUPTED.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CODIVO AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND LICENSORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OF OR INABILITY TO USE THE APP, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE APP WILL NOT EXCEED THE AMOUNTS YOU PAID (IF ANY) FOR THE APP IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY.
Some jurisdictions do not allow certain disclaimers or limitations of liability; in such cases, the above limits apply to the fullest extent permitted.
You agree to defend, indemnify, and hold harmless Codivo and its affiliates, officers, employees, and licensors from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your breach of these Terms, your misuse of the App, or your User Content.
You may not use or export the App in violation of applicable export control, sanctions, or embargo laws. You represent that you are not located in, or a resident of, any country or on any list where the use of the App is prohibited by law.
These Terms are governed by the laws of the Republic of Turkey, without regard to conflict of laws principles. You and Codivo submit to the exclusive jurisdiction and venue of the courts located in Istanbul, Turkey, for any dispute arising out of or relating to these Terms or the App. If you are a consumer resident in the EU/UK or another jurisdiction that requires local consumer courts, you may also bring claims in your country of residence as required by applicable law.
If you downloaded the App from the Apple App Store, your use of the App is also subject to the Apple Media Services Terms and the Apple Licensed Application End User License Agreement (EULA). To the extent these Terms conflict with the Apple EULA, these Terms control between you and Codivo.
Apple is not responsible for providing any maintenance or support for the App, for addressing any claims relating to the App, or for product liability or legal compliance claims. In the event of a third-party claim that the App infringes intellectual property rights, Codivo (not Apple) is responsible for the investigation, defense, settlement, and discharge of such claim to the extent required by these Terms.
We may modify these Terms from time to time. The updated Terms will be posted at https://www.codivo.io/pulsey/terms with a new “Effective date.” Material changes will be highlighted within the document. Your continued use of the App after changes become effective means you accept the new Terms.
